Vote NO on S.1145
As you know, Congress has already passed HR1908. Now the Patent Reform Bill (S.1145) is in front of the Senate, and they looked poised to pass it for Presidential review. It is important that as concerned citizens we stand up and make our voice heard.
Here's an excerpt from Dan Leckrone - The TPL Group:
"America has no greater asset than the ideas generated through hard work and imagination. These ideas have long been protected by Patents, which have played a vital role in America's economic expansion and prosperity. With Patents playing such a principal role in the economic success of the past, it is shocking that the United States Congress, the very body that is meant to represent the interest of the overall good, has decided to pursue a policy that would weaken control of America's ideas and make vulnerable the American economy. This policy is being enacted through the "Patent Reform Act", which has the goal of watering down Patents in order to protect big business from lawsuits -- lawsuits which require payment for the use of the technology appropriated.
While the bill's authors may have sincere intentions, if enacted this law would do a great disservice to the American entrepreneurs. It will drastically weaken the Patent System, making it harder for inventors to protect the ideas they worked to create. The irony behind this legislation is that many of the "Patent Reform Act" prime supporters are businesses that have risen to the top of the industry using the very same Patents they now wish to deteriorate. It is unfortunate that these Companies do not wish to bestow the same opportunities to others that they themselves have received."
Mr. Leckrone pretty much sums it up. Please write your US Congress Representative and US Senators and make them understand that as innovative Americans we feel that all businesses, whether public or private, big or small, deserve the opportunity to develop and protect their own ideas. With the goal of economic equality in mind we join with a growing number of businesses, universities and others who feel that the Patent Reform Act should not weaken the ability of Americans to protect their ideas.
As concerned Americans, what can we do?
First, you can provide your support by posting a quick comment on this blog voicing your concern as US citizens against the "Patent Reform Act". A simple "Please vote NO on S.1145" is sufficient. Once we have a considerable amount of responses, I will be sending an email to ALL US Senators with a link to this blog, so that they can see for themselves that there are a large number of constituents asking them to vote NO on S.1145. When posting a comment, it might be beneficial to include your first name and identify the state in which you reside.
Second, you are highly encouraged to write your US Senators and express your concern that this bill, if passed, will only weaken America's greatest strength and passion, that being our strength and passion to innovate.

Dear Senators,
The patent reform bill S. 1145 is now before you.
I advise you to vote NO. The backlash this Bill will have on our very existence will detract from what our Forefathers provided us in the constitution. I absolutely do not support Patent reform in its current form. Many of the issues don't have anything to do with 'patent reform' such as the limitation of infringers' liability. This basically removes much, if not all, of an infringer's deterrent from infringing. If there are no consequences, then why not just [continue to] infringe??
This makes no sense what-so-ever.. unless that is what this legislation actually desires and supports.
Please don't place a limit on our great countries ability to innovate, and also to defend what is ours... foreign countries are licking their respective chops in anticipation to begin taking advantage of the weakening of the US Patent System this Legislation will affectively result in. Again, is this Congress' goal??

I vehemently oppose s.1145, which I feel clearly harms small business owners, innovators, and inventors throughout our country. Many large corporations that are proponents of this bill are quick to sue in order to protect THEIR patent rights, but they then use "bully tactics" against the individual inventors who have worked so hard, many for a lifetime, to provide the public with innovative products. It is sickening to listen to the Microsofts of the nation, in the highest form of hypocrisy, whine about patent litigation when such companies are often the first ones to the courthouse to protect their own patent portfolios, some of which would fill libraries. This bill should be soundly rejected.

Stop messing with one of the last ways for the little guy to make it big. Big businesses are putting their weight behind this so they can continue to infringe on patented ideas but now with impunity. Proposed patent reforms mean less protection for the underdog.

Suffern, N.Y. - Ever wonder why the US now turns the clock back one hour right after Halloween? According to a book by Michael Downing, it's largely due to the candy lobby that spent much time and money giving out candy-filled pumpkins and making election donations to members of Congress.
Similar forces are at work in another Washington debate that threatens to turn back the clock on innovation as early as February: the so-called Patent Reform Act of 2007. Despite the fact that improvement in some fashion is needed, this sweeping reform, if made law, will undermine the core of the patent system in the United States. It will mean weaker protection for small inventors, university researchers, and entrepreneurs across America.
The frequent characterization of the issue as a struggle between big pharmaceutical companies (against this reform) and the high-tech computer industry (for this reform) is not quite right. In fact, just a handful of high-tech giants – Microsoft, Intel, Cisco, Oracle, and Dell – support the proposed reforms. Small high-tech companies – the true innovators of this industry – overwhelmingly reject them as do innovators from other industries.
There are several serious problems with the current bill. First, the proposed changes weaken the protection patents are meant to afford by introducing an "apportionment of damages" provision that chips away at the economic value of patents. By diminishing damages that would occur from infringing a patent, it devalues all issued and future patents.
Second, the bill creates a mechanism for endless post-grant oppositions. This would throw a cloud of uncertainty over all issued patents, further diminishing the incentive to innovate and invest in the manufacturing of new products. Many inventors, exhausted from defending the validity of their patent repeatedly, will be forced to abandon their patents.
The bill also proposes changing from the American "first-to-invent" system, which favors true innovators, to a European-style "first-to-file" regime, which favors the winners of a sprint to the patent office. Large corporations, with their legions of patent attorneys on staff, would undoubtedly have the upper hand against small inventors and university researchers in this race.
Other proposed changes take the teeth out of patents and make rights harder to enforce. For example, they make it more difficult to prove willful infringement; diminishing the threat of treble damages will only encourage infringement and promote litigiousness.
The proposed changes in US patent law will make it easier for offshore copycats to bring their pirated goods into the US with impunity. More jobs will be lost as a result, with devastating consequences for American

Destroying incentive and innovation is the goal of monopolies and terrorists. These qualities of the american way of life must remain paramount to the US entrepreneur. Regarding S.1145 (as currently written) in my opinion, it would stifle innovation especially for the individual/small inventor where many of our great ideas come from. It is outrageous that Patent Reform Bill S.1145 has already passed through the House and it will be ridiculous if the Senate follows suit. The occasional David vs Goliath story that surfaces when a little guy is able to navigate the bureaucracies and to actually patent an idea, commercialize it and to defend it will be a thing of the past. The ability of the "little guy" to do this is is absolutely a major part of the American Dream for those of us who have an original idea now and again. To shift the system in any way toward big business which S.1145 does by limiting damages for infringement awards will encourage big corporations over the less capitalized to infringe because big business will most assuredly spend a fraction of what they would have spent by infringing (stealing-really) than they would by actually spending the time and money in doing the research and development work themselves. They are already doing this and to limit infringement awards will open the floodgates to such corrupt and greedy behavior. Either way this shifting the system in favor of big business will rip at the fabric of the American Dream. No doubt in my mind. Do you want executives in corporations all over the world considering and deciding to infringe upon intellectual property that individuals and teams have toiled years and years to develop? Does that seem right to you? If S.1145 encourages just such pathetic theft. Please oppose S.1145 in its current form.

I would urge all of our congressional representatives to vote against any patent reform, especially S.1145 in it's present form.
The United States has long been a leader in innovative enhancements that has benefited the entire globe by it's independent research and creativity. Creating the fresh idea is the fundamental backbone of progress and to in any way quell that inspiration can only result in a less progressive future by providing less incentive.

We need clear rules in this matter, we all admit that- perhaps it's time to actually do that. I also think we need more law categories, we can't just continue with these lawsuits and conflicts in patents and inventions.
